Sound Kit Licence

This licence applies to every loop kit, drum kit and sample pack (a "Kit") bought from Samu Soul. By purchasing a Kit you agree to these terms. The sounds are licensed to you, not sold.

2. Licence grant
Samu Soul grants you a non-exclusive, non-transferable, perpetual, worldwide, royalty-free licence to use the audio samples, loops, one-shots and MIDI files in the Kit (the “Sounds”) as part of your own original musical compositions and productions (“Productions”). “Royalty-free” means you do not pay any further fee or royalty for commercial use of Productions, subject to section 4 for melodic loops.
3. Drum sounds, one-shots and FX
Drum hits, drum loops, 808s, one-shots, FX and textures are 100% royalty-free. No credit, clearance or publishing split is required.
4. Melodic loops: credit and clearance
Melodic loops (for example melody, chord, keys, guitar and vocal loops, marked as “Loop Kit” on the product page) are more prominent in a finished song, so the following industry-standard terms apply:
- Independent releases: free to use with no clearance needed. A credit such as “Contains loops by Samu Soul” or co-production credit is appreciated but not required.
- Major placements require clearance before release: if a Production that uses a melodic loop as a prominent or main element is released or distributed by a major record label (Universal, Sony, Warner or their subsidiaries and affiliated distributors), or is used in a sync placement (film, TV, advert, video game or trailer), you must contact us at hello@samu-soul.com before release.
- What clearance involves: there is no upfront clearance fee. Clearance normally requires a co-producer credit for Samu Soul and a publishing/writer share of the composition, negotiated in good faith and proportionate to the loop's contribution. The industry norm is up to 50% of the producer's share of the composition.
- Loops that are changed so heavily that they are no longer recognisable do not need clearance.
5. Restrictions
- You may not resell, lease, sub-license, share, trade, upload to file-sharing or cloud services, or otherwise redistribute the Sounds on their own or as part of any sample library, whether altered or not.
- You may not use the Sounds to train, fine-tune or develop artificial-intelligence or machine-learning models.
- You may not register the Sounds, or Productions consisting mainly of an unaltered loop, with Content ID or any audio-fingerprinting service.
- This licence is personal to the purchaser (or one production team of up to two people working on the same Productions) and cannot be transferred.
6. Ownership
Samu Soul retains all copyright in the Sounds. You own the copyright in your Productions, subject to our underlying rights in the Sounds and section 4.
7. Warranty and liability
The Sounds are original to Samu Soul or fully cleared, and contain no uncleared third-party samples. Your statutory rights under the Consumer Rights Act 2015 are not affected. Otherwise, our liability is limited to the price you paid for the Kit.
8. Termination and law
This licence ends automatically if you breach it; you must then stop distributing Productions that breach its terms. It is governed by the law of England and Wales.
